While the Fifth Circuit has issued a temporary stay on implementation of OSHA’s Emergency Temporary Standard for large employers, this is not the final word.  The next step will be for the various lawsuits (there are others pending in the 6th, 7th, 8th, 11th, and DC Circuits) to be consolidated and assigned to a single court of appeals – to be chosen by lottery (yes, you read that correctly…).  That process is likely to occur next week, but it may be months before we have a ruling –… read more »

COVID-19 Update: Workplace Response to COVID-19/ Coronavirus

As of this writing, the Coronavirus 2019 (COVID-19) has been declared a pandemic by the World Health Organization. There are nearly 1700 cases in the US and 22 cases in Pennsylvania. That number is expected to continue to rise, particularly as testing protocols improve. On a local level, Pennsylvania has experienced multiple school and business closures, Maryland and Ohio have suspended public school classes, and in nearby Montgomery County all schools, gyms, and daycare centers have closed and officials are asking all non-essential businesses to offer paid sick leave and allow employees to work from home.  Nationally, numerous resorts, theme parks and cruise lines… read more »

COVID-19 Update: Emergency Order Regarding Utilities

On Friday, March 13th, 2020, the Pennsylvania Public Utility Commission (the “PUC”) issued an Emergency Order establishing a moratorium on the termination of utility services, including electric, natural gas, water, wastewater, telecommunications, and steam, for all entities which are under the jurisdiction of the PUC.  Tom Wolf’s Proclamation This Emergency Order was in direct response to Governor Tom Wolf’s Proclamation of Disaster Emergency on March 6th, 2020, which authorized and directed the suspension of “the provisions of any regulatory statute prescribing the procedures for conduct of Commonwealth business, or the orders, rules or regulations of any Commonwealth agency, if strict… read more »
