3 Critical Documents and a Letter

access_time Posted on: October 30th, 2025

There are three main documents—plus one letter—that you and your family members can prepare to alleviate most of the legal difficulties that arise in the event of unforeseen circumstances. The Power of Attorney A Power of Attorney (POA) ensures that someone can access information and provide assistance when needed. It designates an individual who can make decisions on your behalf when you are unable to do so. A well-drafted POA anticipates potential issues, does not have an expiration date, and is recognized as legally valid because of how it is written and executed. A POA may authorize one or more… read more »

Protect Your Pets with Estate Planning

access_time Posted on: October 15th, 2025

Documents are important to your furry friends, too For many of us, pets are cherished family members. As an estate planning attorney, I often work with clients who want to ensure their pets are well cared for after they’re gone. Fortunately, this can be accomplished by incorporating provisions into your Will that establish a Pet Trust upon your passing. A Pet Trust offers several important benefits: 1. Legal Recognition of Your Pet’s Care Since pets are legally considered personal property, you can’t leave money directly to them. However, a Trust allows you to earmark funds for their care in a… read more »

Remedies Matter

How many times have you signed a contract without fully reviewing its provisions? Can you recognize the kind of contract where there is room to negotiate provisions to protect yourself versus a contract where you can’t? Recently, Buyers under a Standard Agreement for the Sale of Real Estate (which is a standard form recommended and approved for members of the Pennsylvania Association of Realtors) came to me for advice. After executing the Standard Agreement they used, Seller changed her mind and wanted to sell her property to another family member instead of my client. In response, Seller’s agent presented a… read more »

Corporate Transparency Act Reporting Requirements Deadline Approaching

access_time Posted on: November 14th, 2024

This is an update to our January 16, 2024 article titled “The Corporate Transparency Act and Beneficial Ownership Information Reporting”. At the beginning of this year, the Corporate Transparency Act (“CTA”) became effective. The CTA is intended to aid law enforcement in combating illicit activity, such as money laundering and terrorist financing, conducted through anonymous shell companies. It does so by mandating certain entities, primarily small or medium size businesses, to report “beneficial owner” information to the Financial Crimes and Enforcement Network (“FinCEN”). The CTA authorizes FinCEN, a Bureau of the US Treasurer Department, to collect, protect and disclose this information… read more »

As interest in sustainable living, organic foods, and environmental stewardship grows, so too does the fascination with beekeeping. Business & Corporate Law Guidance: Caveat Emptor (Buyer Beware)

access_time Posted on: December 12th, 2023

“Caveat emptor” was frequently applied to commercial transactions in the past. Caveat emptor is a Latin phrase that translates to “let the buyer beware”. It was a warning to those buying, primarily goods, that they should do their own research and ask pointed questions of a seller before making a purchase. Modern laws concerning the purchase and sale of goods often provide protection in that regard. However, investigating and asking questions remains valuable, even when obtaining services. These days, many legal services are available online. But they are not as helpful or inexpensive as they might seem. For example, you… read more »

Do Your Constituents have the Right-to-Know what You Post on Social Media?

access_time Posted on: August 28th, 2023

Social media is a powerful tool for connecting with constituents. However, the expansion of public discussion through social media encourages an expanded application of the Right-To-Know Law. In an April 2023 case, Penncrest School District v. Cagle, the Commonwealth Court attempted to clarify when a public official’s social media activity would be subject to disclosure. The new test limits the applicability of the Law to social media activity but does not settle the matter, so future litigation will likely clarify the test. The Right-To-Know Law is “designed to promote access to official government information in order to prohibit secrets, scrutinize… read more »
